MONEY / CRYPTO DESK — Germany’s Federal Ministry of Finance has circulated a ministerial draft that would end the one-year tax-free holding perk for newly acquired crypto. Named wraps of Die Welt, Der Spiegel, and specialist outlets such as CryptoTicker and BitcoinWorld, dated around 8–9 September 2026, describe the same skeleton: crypto acquired after 31 December 2026 would be taxed as investment income under the Abgeltungsteuer; holdings bought on or before that cut-off stay under today’s Section 23 private-disposal rules as the draft stands. Rate and surcharge as the wraps print them. The base flat withholding rate everyone quotes is 25 percent. Add the 5.5 percent solidarity surcharge on the tax itself and the effective figure commonly cited is about 26.375 percent before any church tax. Der Spiegel’s report on Finance Minister Lars Klingbeil’s draft places crypto gains alongside shares under the Abgeltungsteuer from the new acquisition window, with the saver’s allowance (Sparer-Pauschbetrag, currently €1,000) still usable and a favourability check where personal rates sit below 25 percent. Extra attributes those rate lines to the ministry draft as reported — it does not invent a church-tax matrix for every Land.
It is unfair when hard-earned income and capital gains are taxed, but gains from crypto speculation can become largely tax-free.
Cut-off, entry into force, withholding. As the draft stands in the WELT / CryptoTicker / BigGo wraps: acquisition after 31 December 2026 falls under the new regime; the law is aimed at entering into force on 1 January 2027; automatic withholding by crypto service providers is not due to begin before 1 January 2028. Grandfathering is acquisition-date based: a coin bought in December 2026 whose one-year clock runs into December 2027 would still qualify under old rules if the draft survives as written. Instalment buys split across the New Year would split treatment by execution date. Extra does not tell readers when to buy or sell.
Revenue line — attributed, not celebrated. Draft fiscal notes summarised in CryptoTicker and BitcoinWorld put expected additional revenue at about €160 million from 2028, rising toward roughly €350 million a year by 2031, against a federal budget measured in the hundreds of billions. Extra prints the €160m / 2028 figure as a ministry estimate from the draft wraps. It does not turn a budget line into a market call.
What else the draft is said to touch. Specialist wraps say staking and lending income would be treated as investment income; crypto losses could be offset against shares and other securities under the draft’s loss rules. Der Spiegel notes the political frame from ministry circles: it is unfair, they say, if labour and conventional capital gains are taxed while crypto speculation can go largely tax-free after one year. Extra shelves that politics as attribution. It does not endorse a party line.
Status check — nothing is Federal Law Gazette yet. The paper is in interdepartmental consultation. It still needs cabinet approval and parliamentary passage. Named outlets note earlier crypto-tax attempts died on the road. Extra will not pretend a ministerial draft is statute. VIDEO=no.
